PLEASE READ THESE TERMS & CONDITIONS CAREFULLY BEFORE ACCESSING OR USING THE SERVICES. BY ACCESSING OR USING OUR SERVICES, YOU AGREE TO BE BOUND BY THE FOLLOWING TERMS AND CONDITIONS.

BYRON BAY TAXIS & LIMOUSINES PTY LTD reserves the right to amend prices or itinerary, (i.e. alter travel routes or itinerary) due to road, weather or traffic conditions; or if required by the size, behaviour or other condition of the group. All of our services are calculated by either the distance travelled (transfer) or the length of time a vehicle is booked (hourly).  The actual rate is calculated electronically and is further dependent on the type of vehicle you require and the area you are travelling to and from.  While in the vast majority of cases we are able to provide you with a price quote for your particular journey, there are instances where the actual cost will vary.

Your access and use of our electronic mobile application (the “BYRON BAY TAXIS APP”) is governed by BYRON BAY TAXIS & LIMOUSINES PTY LTD ’s Terms and Conditions of Use, including any amended Terms and Conditions (“Terms and Conditions”). Access and use of our Services constitutes your agreement to be bound by these Terms and Conditions, establishing a contractual relationship between the you and BYRON BAY TAXIS & LIMOUSINES PTY LTD. If you do not agree with these Terms, you may not access or use our Services.

Subject to your compliance with these Terms and Conditions, BYRON BAY TAXIS & LIMOUSINES PTY LTD grants you temporary access to the BYRON BAY TAXIS APP on your personal device, solely in connection with your use of the Services.

You undertake to only utilise the BYRON BAY TAXIS APP for the purpose to use our Services under these Terms and Conditions. You may not use in any shape, manner or form or any portion of the BYRON BAY TAXIS APP. A breach in this undertaking will result in claims for infringement of BYRON BAY TAXIS & LIMOUSINES PTY LTD ’s intellectual property.

You must register and maintain a user Services account (“Account”) to use most aspects of the Services. You must be 18 years of age to register for an Account and you understand and accept full responsibility to maintain accurate, complete and up-to-date Account information.

By creating an Account, you agree to receive informational communications from time to time in the form but not limited to Short Messaging Service (SMS) and E-Mail.

You are responsible for your own data network access to use the BYRON BAY TAXIS APP and Services. You are responsible for acquiring and updating compatible hardware or devices to access and use the Services and any updates hereto. Your mobile network data and messaging rates and fees may apply and the cost thereof does not form part of our Service fee. BYRON BAY TAXIS & LIMOUSINES PTY LTD does not guarantee that the Services, or any portion thereof, will function on any particular hardware or devices. In addition, the Services may be subject to malfunctions and delays inherent in the use of the Internet and electronic communications.

All Charges are due immediately and payment will be facilitated by BYRON BAY TAXIS & LIMOUSINES PTY LTD using the preferred payment method nominated and authorised for use in your Account.

You are responsible for the cost of repair for damage to, or necessary cleaning of vehicles and property resulting from the use of the Services under your Account. In the even that a vehicle requires the need for repair or cleaning in excess of normal “wear and tear”, and such repair or cleaning is verified by BYRON BAY TAXIS & LIMOUSINES PTY LTD in BYRON BAY TAXIS & LIMOUSINES PTY LTD ’s reasonable discretion. Repair or cleaning charges are non-refundable.

BYRON BAY TAXIS & LIMOUSINES PTY LTD Services, including Services by third party providers are provided subject to the Terms and Conditions. BYRON BAY TAXIS & LIMOUSINES PTY LTD  disclaims all representations and warranties, express, implied or statutory with regard to the use of the BYRON BAY TAXIS APP. BYRON BAY TAXIS & LIMOUSINES PTY LTD  makes no representation, warranty or guarantee regarding reliability, timeliness, quality, fitness for a particular purpose, non-infringement, suitability or availability of the Service or that the Service will be interrupted or error free.

You accept any and all risk arising in connection with the use of the BYRON BAY TAXIS APP and Services and You fully indemnify BYRON BAY TAXIS & LIMOUSINES PTY LTD  its officers, directors, employees, agents and third party service providers harmless from any and all claims, demands, damages (both direct and indirect), financial or personal losses, bodily harm or injuries, liabilities and expenses (including attorneys’ fees) arising out of or in connection with the BYRON BAY TAXIS APP and related Services.

The limitations and disclaimer do not purport to limit liability or alter your rights as a consumer that cannot be excluded under applicable law.

You may not assign or transfer these Terms in whole or in part without BYRON BAY TAXIS & LIMOUSINES PTY LTD ’s prior written approval. You give your approval to BYRON BAY TAXIS & LIMOUSINES PTY LTD  for it to assign or transfer these Terms in whole or in part, including to: (i) a subsidiary or affiliate; (ii) an acquirer of BYRON BAY TAXIS & LIMOUSINES PTY LTD ’s equity, business or assets; or (iii) a successor by merger. No joint venture, partnership, employment or agency relationship exists between you, BYRON BAY TAXIS & LIMOUSINES PTY LTD  or any Third Party Provider as a result of the contract between you and BYRON BAY TAXIS & LIMOUSINES PTY LTD  or use of the Services.

Our collection and use of personal information in connection with the Services is as provided in BYRON BAY TAXIS & LIMOUSINES PTY LTD ’s Privacy Policy. BYRON BAY TAXIS & LIMOUSINES PTY LTD  may provide to a claims processor or an insurer any necessary information (including your contact information) if there is a complaint, dispute or conflict, which may include an accident, involving you and a Third Party Provider or Law enforcement when such information or data is necessary to resolve the complaint, dispute or conflict.

If any provision of these Terms is held to be illegal, invalid or unenforceable, in whole or in part, under any law, such provision or part thereof shall to that extent be deemed not to form part of these Terms but the legality, validity and enforceability of the other provisions in these Terms shall not be affected. In that event, the parties shall replace the illegal, invalid or unenforceable provision or part thereof with a provision or part thereof that is legal, valid and enforceable and that has, to the greatest extent possible, a similar effect as the illegal, invalid or unenforceable provision or part thereof, given the contents and purpose of these Terms. These Terms constitute the entire agreement and understanding of the parties with respect to its subject matter and replaces and supersedes all prior or contemporaneous agreements or undertakings regarding such subject matter. In these Terms, the words “including” and “include” mean “including, but not limited to.”

Festivals

We reserve the right to set prices for festival transfer bookings to account additional costs and disruptions experienced.

Cancellation and Refund policy.

• 100% of fare less $20 admin fee if cancel >48hrs before trip. 

• 80% of fare less $20 admin fee if cancel 24-48hrs before trip.

• 50% of fare less $20 admin fee if cancel 12-24hrs before trip.

• No refund if cancel <12hrs before trip.

• No refund if not at pick up point at designated time

  • Driver will make attempts to connect, phone must be answered.

Byron Bay Taxis & Limousines booked fare rates.

The booked service fares are as follows;

Govt Passenger Service Levy $1.32

Network Booking fee $2.50

Hiring Charge: $4.60 (sedan) $6.90 (maxi 5+ pax)

Distance Rate: $3.50 per kilometre for the first 12 kilometres and $3.89 per kilometre thereafter

Distance Rate Maxi (5+ pax): $5.25 per kilometre for the first 12 kilometres and $5.84 per kilometre thereafter

Waiting Time: 99.0 cents per minute ($59.40 per hour)

Tolls are payable in addition to the fare if the taxi incurs a toll during the hiring.

Ballina Airport charge a $3.00 fee for operators to drop off and pick up from the airport and this fee is on charged to customers.

Maxi-cabs – 9+ passengers. An amount of 175% of the fare and other arrangements is calculated and payable.

Late night rate applies for all bookings; 12 midnight – 5am, Sunday to Thursday and 1am – 5am Friday to Saturday, +20% will automatically added to the fare.

Multiple Hirings - An amount of 75% of the fare and other arrangements payable in accordance with this option may be demanded by the driver from each hirer of a taxi service that is a multiple hiring.

The amount of a non-cash payment surcharge payable for a passenger service provided by a booking and taxi service provider is 5% inclusive of GST.

Cleaning fee - If, during the course of a taxi service, a passenger soils a taxi in such a manner that the taxi is no longer clean and tidy and the taxi could not reasonably be expected to be used to provide a passenger service before being cleaned, the driver is entitled to collect, and the hirer must pay, a cleaning fee that may not exceed $120.00 (plus GST)
